The Sites are made available by Suit Sharks LLC (“Company,” “we,” or “us”). The terms “you,” “your,” and “user” refer to anyone who accesses or uses a Site.
1. Acceptance and Modification of Terms
By accessing or using the Sites, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Use and all related policies (including our Privacy Policy, Return & Exchange Policy, Shipping Policy, and any supplemental policies). If you do not agree, do not access or use the Sites. Continued use of the Sites after any updates constitutes acceptance of such changes.
2. Proprietary Rights and Use License
All content, code, data, and materials available on the Sites (“Site Content”) are the property of Suit Sharks LLC or its licensors. All rights reserved. You may not copy, reproduce, distribute, modify, display, sell, or exploit any Site Content without prior written consent. Any derivative works, feedback, or enhancements become the sole property of Suit Sharks LLC. You agree not to use any data for AI training, scraping, or competitive analysis without express authorization.
3. User Accounts
You are responsible for maintaining confidentiality of your login credentials and all activities under your account. Suit Sharks LLC is not liable for losses resulting from unauthorized access or use. You agree to promptly notify us of any breach or suspected unauthorized activity. We reserve the right to suspend or terminate any account at our discretion without notice.
4. Submitted Materials
Any ideas, reviews, images, or materials submitted to the Site (“Submitted Materials”) are deemed non-confidential and grant Suit Sharks LLC a perpetual, worldwide, royalty-free license to use, modify, distribute, and display such content in any media. You waive all moral rights and agree that you will not post defamatory, infringing, or false content. Negative reviews intended to harm brand reputation or influence negotiations are prohibited.
5. Orders, Payments, and Chargebacks
By purchasing through the Sites, you agree to all related policies. Chargebacks or disputes for properly delivered goods are strictly prohibited. Fraudulent activity may be reported to credit agencies and law enforcement. Suit Sharks LLC reserves the right to refuse or cancel orders suspected of abuse, fraud, or resale. All prices are in USD and subject to change without notice.
6. Disclaimers and Limitation of Liability
The Sites and all related materials are provided “AS IS” and “AS AVAILABLE.” Suit Sharks LLC disclaims all warranties, express or implied. To the fullest extent permitted by law, Suit Sharks LLC’s total liability shall not exceed the purchase price paid for the product or $100, whichever is less. Suit Sharks LLC is not liable for indirect, incidental, or consequential damages, data loss, or delays caused by third parties or events beyond our control (“Force Majeure”).
7. Arbitration and Governing Law
All disputes arising from these Terms shall be resolved through binding arbitration conducted by the American Arbitration Association (“AAA”) under its rules in Travis County, Texas. The governing law shall be the laws of the State of Wyoming, without regard to conflict of law principles. You waive the right to participate in any class action or jury trial. Either party may bring a claim in small claims court within its jurisdiction for qualifying matters.
8. Indemnification
You agree to indemnify and hold harmless Suit Sharks LLC, its officers, employees, and affiliates from any claims, damages, or expenses, including attorney fees, arising out of your use of the Sites, violation of these Terms, or breach of third-party rights, including any governmental or regulatory investigations.
9. Termination
Suit Sharks LLC reserves the right to suspend or terminate your account or access at any time for violations of these Terms, misuse, chargeback abuse, or fraudulent activity. Termination does not limit Suit Sharks LLC’s rights to seek additional remedies under law.
10. General Provisions
These Terms constitute the entire agreement between you and Suit Sharks LLC. No partnership, joint venture, or agency relationship is created by your use of the Sites. All communications may be delivered electronically. The provisions relating to intellectual property, limitation of liability, arbitration, and indemnification shall survive termination.
